The Byrd Rule (named for Sen. Robert Byrd of West Virginia) prohibits provisions in reconciliation bills that are "extraneous" — meaning they have no direct budgetary effect, or the budgetary effect is incidental to the policy purpose. The Senate Parliamentarian decides whether a provision violates the Byrd Rule. If challenged, a provision can be stripped from a bill by a simple majority vote. This rule limits what Republicans can include in party-line reconciliation bills. Funding ICE operations for three years in a reconciliation bill could face Byrd Rule challenges if the funding is deemed primarily a policy — not budget — decision.
