Justice Alito extends mifepristone administrative stay through May 14

Supreme Court Justice Samuel Alito, acting as circuit justice for the Fifth Circuit, extended an administrative stay blocking a federal appeals court ruling that would have restricted mifepristone access under FDA's Risk Evaluation and Mitigation Strategy program. The stay kept telemedicine prescribing and mail delivery of the abortion pill available through May 14, 2026, while the full court considered an emergency application. Louisiana Attorney General Lorie Ann Murrill and the Alliance Defending Freedom had asked the Fifth Circuit to reinstate restrictions lifted by the FDA in 2021.
