DHS Issues Final Rule Replacing H-1B Lottery with Wage-Weighted Selection
The Department of Homeland Security published a final rule replacing the random H-1B cap lottery with a wage-level-weighted selection system. Under the new system, Level IV (highest-wage) registrations receive 4x selection odds, Level III 3x, Level II 2x, and Level I 1x. The rule, effective February 27, 2026, aims to prioritize higher-skilled, higher-paid workers over entry-level applicants. Critics warn it disadvantages recent graduates; supporters say it reduces abuse of the cap.
