Congress Declines to Use War Powers or Impoundment Checks Against Trump
By spring 2025, Congress had not invoked the National Emergencies Act to terminate any of Trump's declared emergencies, not used the Impoundment Control Act to challenge DOGE-directed spending freezes, and not exercised War Powers Resolution authority. Republican majorities instead advanced reconciliation legislation that codified many DOGE spending reductions into law. The abdication left the executive acting in Youngstown Zone 3 conditions — against or without congressional sanction — without the institutional resistance the Constitution anticipated.
