Biden pauses all TPS terminations, extends protections for Yemen and other countries

President Biden signs an executive order pausing implementation of TPS terminations initiated by the Trump administration and directing DHS to review all pending terminations within 180 days. The order stops terminations for El Salvador, Haiti, Nicaragua, Sudan, Nepal, and Honduras that had been working through the courts. For Yemen, which had been extended through the Biden transition, the administration signals it will maintain TPS given ongoing conflict. Biden Secretary of Homeland Security Alejandro Mayorkas later formally extends Yemen's TPS. The reversal affects more than 300,000 people who had faced deportation orders and resets the TPS clock — until Noem terminates Yemen's TPS in March 2026.
