Second Circuit rules interior immigrants are entitled to bond hearings

The Second Circuit Court of Appeals ruled in April 2026 that federal immigration law does not permit mandatory detention without bond hearings for people arrested in the interior of the United States who entered the country illegally years or decades earlier. The court rejected the government interpretation that these individuals are applicants for admission under Section 1225 and held that Section 1226 with its individualized review requirement applies.
