Congress reauthorizes FISA Section 702 without adding a warrant requirement

President Trump signed a six-year reauthorization of FISA Section 702 on January 19, 2018, after the House rejected an amendment that would have required a warrant before the FBI could query Americans' communications incidentally collected under the program. The measure passed 256-164 in the House and 65-34 in the Senate. Trump briefly created confusion by tweeting that Section 702 could be used for political surveillance before quickly reversing and endorsing the bill. Privacy advocates failed to add the warrant requirement that would remain the central point of contention in every subsequent renewal.
