Commerce Secretary Howard Lutnick filed his Office of Government Ethics recusal agreement on February 20, 2025, committing to step back from decisions directly affecting Cantor Fitzgerald and BGC Partners. Ethics watchdog groups immediately flagged that the agreement's scope was narrower than full divestiture and that OGE lacked authority to independently monitor compliance or remove Lutnick if he violated the pledge. Under the Ethics in Government Act, enforcement of recusal agreements depends entirely on the agency's Designated Agency Ethics Official and ultimately on the president — neither of whom has an independent incentive to discipline a sitting cabinet secretary.
