Trump ends duty-free de minimis treatment for all low-value packages

Following the Supreme Court's invalidation of IEEPA tariffs, President Trump issued an executive order on February 25, 2026, maintaining the suspension of duty-free de minimis treatment for low-value international shipments regardless of origin, replacing the previous IEEPA authority with Section 122 tariff coverage. The de minimis threshold, which had allowed packages valued under $800 to enter the United States duty-free since 1938, was eliminated for postal shipments, directly targeting the business models of Chinese fast-fashion retailers Shein and Temu and e-commerce platforms relying on direct-to-consumer international shipping.
