Eighth Circuit Court issues administrative stay of SAVE Plan implementation
The U.S. Court of Appeals for the Eighth Circuit issues an administrative stay temporarily blocking implementation of the Biden administration's SAVE Plan income-driven repayment program. The stay is requested by a coalition of Republican-led states and the Job Creators Network Foundation, who argue the Education Department lacked authority to unilaterally establish the plan following the Supreme Court's Biden v. Nebraska decision rejecting debt cancellation. The stay pauses new enrollment in SAVE while legal challenges proceed. Federal judge Jennifer Dorow grants the stay, finding plaintiffs likely to succeed on the merits of their challenge to the plan's legality.
