FCC restores net neutrality under Biden reclassifies broadband as telecommunications service
The Federal Communications Commission, now with a Democratic majority under Chair Jessica Rosenworcel, votes 3-2 to restore net neutrality rules, reclassifying broadband internet service as a telecommunications service under Title II of the Communications Act. The rules prohibit internet service providers from blocking or throttling legal content or creating paid "fast lanes" that favor those who pay more. The restoration reverses the Trump FCC's 2017 repeal of net neutrality. The rules are challenged in court by telecom industry groups and later vacated by the 6th Circuit Court of Appeals in August 2024, citing the Supreme Court's Loper Bright decision overturning Chevron deference.
