Supreme Court Ethics Act

This bill establishes a new statutory requirement for the Judicial Conference of the United States to issue a judicial code of conduct for judges and justices of U.S. courts, including Justices of the Supreme Court. Currently, the Judicial Conference issues a code of conduct for judges of U.S. courts (but not for Justices of the Supreme Court).

To enforce the code of conduct for Justices of the Supreme Court, the bill requires the Supreme Court to appoint an ethics investigations counsel. The ethics investigations counsel must

adopt rules to enforce the code of conduct, including a process to receive public complaints of potential violations;
investigate complaints; and
issue an annual public report describing the complaints and the steps taken to address the complaints.

Finally, the bill requires a Justice of the Supreme Court to publicly disclose the reasons for disqualifying himself or herself in a proceeding or the reasons for denying a motion to disqualify himself or herself in a proceeding.

Ensuring Patient Access to Critical Breakthrough Products Act of 2023

This bill provides for Medicare coverage of medical devices that are approved under the Food and Drug Administration (FDA) Breakthrough Devices Program. (Under the program, manufacturers work with the FDA to expedite the review and approval of certain medical devices that provide for more effective treatment or diagnosis of life-threatening or irreversibly debilitating human diseases or conditions.)

The bill allows designated medical breakthrough devices to be temporarily covered under Medicare during a four-year transitional period. The Centers for Medicare & Medicaid Services (CMS) must assign payment codes for such devices within three months of FDA approval. The CMS must also establish a process to allow for continued coverage after the transitional period has expired, taking into account any additional evidence or data the CMS deems necessary.

The CMS must also provide for temporary and, where appropriate, permanent Medicare coverage of breakthrough devices for which there is no existing benefit category (i.e., classification).

Sheila Cherfilus-McCormick (D-FL), after a bipartisan subcommittee found 25 of 27 ethics charges proven against her at a March 26 hearing. Prosecutors allege she stole $5 million in federal pandemic disaster funds, funneled money through friends and relatives who donated it back to her congressional campaign disguised as personal contributions, and spent some of the money on a $250,000 diamond ring. Speaker Mike Johnson (R-LA) said she "should be expelled," and Rep. Anna Paulina Luna (R-FL) issued a public ultimatum: "Either resign or be expelled." Expelling a House member requires a two-thirds vote of the full chamber — roughly 290 members — meaning a significant number of Democrats would have to join Republicans. Only five House members have ever been expelled, most recently James Traficant in 2002. Cherfilus-McCormick has denied wrongdoing and declined to resign, forcing the Ethics Committee to proceed to a public sanction hearing.
