The returning resident presumption, codified at 8 U.S.C. § 1101(a)(13)(C), protects lawful permanent residents who travel abroad by presuming they are returning to their existing US home rather than "seeking admission" as a new entrant. An LPR loses this presumption if they abandoned their US domicile, stayed abroad more than 180 days, or committed certain criminal offenses. When the presumption applies, the LPR is placed in deportation proceedings under 8 U.S.C. § 1227 (for admitted noncitizens), which provides stronger procedural protections than the inadmissibility track under § 1182 that applies to those "seeking admission."
