Musk Files Notice Seeking Up to $134B from OpenAI and Microsoft in Nonprofit Breach Case

Cal.), Musk filed a Notice of Remedies seeking disgorgement of up to $134 billion in wrongful gains from OpenAI and Microsoft — claiming OpenAI gained $65.5B–$109.4B and Microsoft gained $13.3B–$25.1B from his early co-founding contributions made under nonprofit promises. Musk accused defendants of "looting the nonprofit" by converting OpenAI's for-profit subsidiary into a public benefit corporation. Trial was set for April 2026.
