Coalition of Democratic AGs and civil liberties groups files suit in EDVA challenging Anti-Weaponization Fund as unlawful
A coalition of twenty Democratic state attorneys general, the ACLU, and the Lawyers' Committee for Civil Rights filed suit in the Eastern District of Virginia challenging the Anti-Weaponization Fund. The complaint argued that 31 U.S.C. § 1304 does not authorize payments on claims that have not been adjudicated by a court, that the fund violated equal protection by selecting claimants based on political viewpoint, and that Treasury had circumvented the Appropriations Clause. Plaintiffs sought a temporary restraining order and preliminary injunction to block all disbursements.
