Seventh Circuit Upholds Consent Decree, Narrows Release Order
On May 5, 2026, the 7th U.S. Circuit Court of Appeals upheld the Castanon Nava consent decree and agreed the government couldn't place people already living in the country into mandatory detention without individualized review. The court affirmed release for class members arrested without warrants but required case-by-case findings and exempted people arrested on I-200 warrants. The ruling narrowed how many of the 615 would actually go free.
