Illinois bans AI discrimination in hiring under expanded civil rights law
Illinois Governor JB Pritzker signs HB 3773 into law, amending the Illinois Human Rights Act to prohibit employers from using AI screening tools that produce discriminatory outcomes in hiring, even if discrimination is unintentional. The law requires employers to notify applicants when AI is used in screening and gives the Illinois Department of Human Rights authority to audit employer AI systems. The law is the first in the US to treat AI-generated disparate impact in hiring as a civil rights violation under existing discrimination law rather than requiring a new AI-specific framework. EEOC staff cite it as a model for federal guidance.
