ICE sent a confidential directive to 287(g)-participating local law enforcement agencies in Texas and Florida between April 19 and May 5, 2026, instructing them not to respond to Freedom of Information Act requests or state public records requests about 287(g) activities without first consulting ICE. The memo claimed that records generated through 287(g) participation are "under the control of ICE" rather than the local agency. It also directed agencies to seek ICE approval before holding press conferences, issuing press releases, or allowing media ride-alongs related to 287(g) operations. Sweetwater, Florida City Attorney Ralph Ventura issued internal guidance citing the directive and instructing staff to call him before discussing 287(g) publicly.
