Democrats appeal Judge Nichols' refusal to block Trump mail-ballot order to the D.C. Circuit, putting Elections Clause question before appellate court

The Democratic National Committee, DCCC, DSCC, Democratic Governors Association, Senate Minority Leader Chuck Schumer, and House Minority Leader Hakeem Jeffries filed a notice of appeal at the U.S. Court of Appeals for the D.C. Circuit on June 1, 2026. They challenged Judge Carl Nichols' May 28 ruling that declined to block Trump's March 31 executive order on ripeness grounds. USPS had published its proposed implementing rule on May 29, which Democrats argued made the ripeness objection moot.
