Supreme Court rules 9-0 government must facilitate Abrego Garcia return in Noem v. Abrego Garcia
The Supreme Court unanimously held on April 10, 2025 that the Trump administration must "facilitate" the release and return of Kilmar Abrego Garcia from CECOT, where he had been wrongly sent on March 15. The Court upheld the facilitation requirement but found the lower court's use of "effectuate" went too far given the limits of U.S. authority over a foreign sovereign. Justices Sotomayor, Kagan, and Jackson filed a statement expressing concern about administration noncompliance. Only Alito and Thomas would have allowed additional deportation flights to proceed at an earlier stage.
