Judge Dale Ho issues preliminary injunction blocking Yemen TPS termination

U.S. District Judge Dale Ho of the Southern District of New York issues a preliminary injunction blocking DHS Secretary Kristi Noem's termination of Yemen's Temporary Protected Status, which had been set to expire May 4, 2026. Judge Ho finds plaintiffs are likely to succeed on the merits of their claim that Noem violated the Administrative Procedure Act by terminating TPS without completing the country conditions review required by 8 U.S.C. § 1254a. He also finds the 2,810 current TPS holders and 425 pending applicants would suffer irreparable harm if protections lapsed. The injunction keeps Yemen's TPS in force while the case proceeds. The ruling comes one day after the Supreme Court heard arguments in a related case that could strip courts of authority to review TPS termination decisions.
