Biden administration restores NAIJ union certification for immigration judges

The Biden administration reversed the NAIJ decertification in February 2021, directing the Federal Labor Relations Authority to restore NAIJ as the certified bargaining unit for immigration judges. Acting EOIR Director Jean King oversaw the policy reversal. The restoration reinstated collective bargaining rights and grievance procedures for approximately 500 immigration judges, reversing the Trump-era ruling that had classified judges as management officials ineligible for union membership.
