Cleveland police detective Martin McFadden, a 39-year veteran, observed John Terry and Richard Chilton repeatedly walking past a downtown store and peering in the window on October 31, 1963. McFadden, suspecting the men were casing the store for robbery, approached them, identified himself, and patted down their outer clothing without a warrant and without probable cause to arrest. He found a pistol on Terry and Chilton. Terry was charged with carrying a concealed weapon; his attorney, future Congressman Louis Stokes, sought to suppress the guns as the product of an unconstitutional search.
