Biden fixes ACA family glitch up to 1 million family members gain coverage
The Biden administration finalizes a rule fixing the ACA's so-called "family glitch," a decade-long loophole that had blocked millions of family members from accessing subsidized marketplace coverage. Under the old rule, if an employer offered affordable self-only coverage to a worker, the worker's family members were ineligible for premium tax credits on the ACA marketplace, even if the family plan was unaffordable. The fix, effective January 2023, deems employer coverage "affordable" based on the family coverage cost rather than just the individual cost. Treasury Secretary Yellen estimates up to 1 million people will gain coverage or have lower premiums. It is one of the most notable ACA regulatory fixes since the law was enacted.
