Federal district court rules against Tinker students, holding school administrators had authority to prevent disruption of school discipline
The U.S. District Court for the Southern District of Iowa dismissed the Tinker students' lawsuit, ruling that the Des Moines school district had acted within its authority to prevent potential disruption to the school environment. Judge Roy Stephenson applied the standard from Burnside v. Byars (5th Cir. 1966), which allowed schools to restrict student expression when it 'interferes, or is likely to interfere' with school operations. Applying this standard, the court found that the armband policy was reasonable given the political context of the Vietnam War and the potential for controversy among students.
