Obama Signs FDA Tobacco Control Act, Setting Stage for Vaping Regulation
President Obama signed the Family Smoking Prevention and Tobacco Control Act on June 22, 2009, granting the FDA authority to regulate tobacco products for the first time in the agency's history. The law required premarket authorization for new tobacco products, restrictions on marketing to youth, and disclosure of ingredients. FDA extended its authority to e-cigarettes and vaping devices in 2016 under the Deeming Rule, requiring manufacturers to submit premarket tobacco product applications for all vaping products — applications the FDA would take years to process.
