Louisiana files APA lawsuit challenging FDA 2023 rule allowing mail-order mifepristone

Louisiana Attorney General Liz Murrill files an Administrative Procedure Act lawsuit on October 6, 2025, challenging the FDA's 2023 modification of the mifepristone REMS that allows the drug to be dispensed by mail. Louisiana argues that the rule unlawfully circumvents the state's abortion ban by enabling Louisiana residents to obtain mifepristone through out-of-state telehealth providers and mail. The lawsuit is assigned to Judge Joseph in the Western District of Louisiana, who issues a preliminary finding in April 2026 that Louisiana is likely to succeed on the merits. The case proceeds in parallel with the Fifth Circuit's ruling blocking mail-order mifepristone, creating a growing circuit-level conflict over the scope of FDA authority over abortion pill access.
