Attorneys file class action challenging ICE's practice of deporting people to third countries without hearings
Attorneys filed D.V.D. v. Department of Homeland Security in U.S. District Court in Massachusetts, challenging ICE practice of deporting noncitizens to countries other than their home countries without notice or opportunity to raise CAT protection claims. U.S. District Judge Brian Murphy heard the case and on April 18, 2025 issued a preliminary injunction requiring ICE to provide written notice in a language the person understands before any third-country removal. On May 21, Judge Murphy found the government had violated his order when it deported six people to South Sudan without following required procedures.
