Ohio voters approve Issue 1 by 57-43, enshrining abortion rights up to viability in the state constitution
On November 7, 2023, Ohio voters approved Issue 1, a ballot amendment establishing a state constitutional right to abortion up to fetal viability (typically 22-24 weeks) and to contraception, fertility treatment, and miscarriage care, by a margin of 56.6% to 43.4%. Ohio Republicans had attempted in August 2023 to raise the threshold for constitutional amendments from 50% to 60% — in part to block the abortion measure — but voters rejected that effort 57-43. The November Issue 1 victory was the seventh consecutive ballot measure win for abortion rights advocates since Dobbs, in a state Trump had won by eight points in 2020, and passed despite substantial opposition spending by Republican-aligned groups.
