Federal Judge Ana Reyes issued preliminary injunction on February 2, 2026 blocking Haitian TPS termination. The 83-page injunction found that DHS Secretary
Kristi Noem acted arbitrarily and capriciously under the Administrative Procedure Act when attempting to terminate Temporary Protected Status for Haiti.
The ruling found the termination tainted by discriminatory animus from presidential statements. Judge Reyes cited Trump statements about Haitian immigrants and concluded that the termination decision was influenced by racial prejudice rather than legitimate country conditions analysis.
The injunction preserved TPS for approximately 350,000 Haitian nationals nationwide. These individuals can continue living and working legally in the United States while the legal challenge proceeds through the court system.
The case was filed by National TPS Alliance and advocacy groups in July 2025. The lawsuit challenged the termination on multiple grounds, including violations of the Administrative Procedure Act, constitutional equal protection claims, and failure to properly consider country conditions.
TPS for Haiti was originally designated after the 2010 earthquake and has been extended multiple times due to ongoing humanitarian crises. The country has faced political instability, natural disasters, and economic collapse that make safe return impossible for many Haitians.
Judge Reyes found that DHS failed to properly consider the humanitarian impact of termination. The ruling criticized the agency for not adequately analyzing the conditions in Haiti or the potential harm to Haitians who would be forced to return.
The injunction is temporary but maintains the status quo while the case proceeds. The final outcome will depend on whether the government can overcome the preliminary findings of arbitrary action and discriminatory animus.
The ruling sets important precedent for TPS challenges and administrative law. Other countries with TPS designations could face similar challenges if the Trump administration attempts to terminate their protected status without proper analysis.
