Allen v. Milligan: Roberts Upholds VRA, Orders Alabama Second Black District
The Supreme Court ruled 5-4 in Allen v. Milligan that Alabama's 2021 congressional map likely violated Section 2 of the Voting Rights Act by packing Black voters into one district. Chief Justice Roberts wrote the majority, joined by Justices Kavanaugh, Kagan, Sotomayor, and Jackson, reaffirming the Thornburg v. Gingles three-part test. Justice Thomas dissented, joined by Gorsuch, Alito, and Barrett, arguing Section 2 should not apply to redistricting. The ruling required Alabama to draw a second district where Black voters could elect their preferred candidate.
