Supreme Court Agrees to Hear Trump v. Barbara, Birthright Citizenship Challenge Under 14th Amendment

The Supreme Court agreed on December 5, 2025 to hear Trump v. Barbara (also known as Barbara v. Trump), a nationwide class action challenging Trump's executive order seeking to end birthright citizenship for children of undocumented immigrants and those on temporary visas. The case was brought by the ACLU on behalf of babies who would be stripped of citizenship. The Court's decision to take the case — despite every lower court blocking the order — signaled potential willingness to revisit the 14th Amendment's guarantee of citizenship to all born on U.S. soil.
